1. Agreement to Terms

6. Payment Terms

Your use of our services is also governed by our Privacy Policy. We collect, use, and protect your data in accordance with applicable data protection laws.

9. Warranties and Disclaimers

We warrant that our services will perform substantially in accordance with the documentation provided.

EXCEPT AS EXPRESSLY PROVIDED, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOM DIGITAL TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless ATOM DIGITAL TECHNOLOGIES from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

12. Term and Termination

12.1 Term

These Terms remain in effect while you use our services.

12.2 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

12.3 Termination by Us

We may suspend or terminate your access to services immediately if you breach these Terms or for other reasons at our discretion.

12.4 Effect of Termination

Upon termination, your right to use our services will immediately cease. We may delete your data in accordance with our data retention policies.

13. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information exchanged during the provision of services.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.

16. Dispute Resolution

In the event of any dispute, the parties agree to first attempt to resolve the matter through good faith negotiations. If unsuccessful, disputes may be resolved through arbitration in Dubai in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

17. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, labor disputes, or internet service failures.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and ATOM DIGITAL TECHNOLOGIES regarding the use of our services.
